The Constitution of India protects you. Police are public servants, not masters. Today, we break down the specific laws that prevent illegal harassment and empower you to stand your ground safely.
1. The Right to Identification
The Law: Under Supreme Court guidelines, every officer MUST wear a visible name tag and designation.
Real-Life Case: If an officer in civil clothes stops you, you are legally entitled to say: "Sir, please show me your ID and Name Plate before we proceed."
2. The "Arrest Memo" Requirement
Police cannot simply "pick you up." They must prepare an **Arrest Memo** at the spot. It must contain the Date, Time, and Location of the arrest.
Crucial Point: It must be signed by at least one witness (family or neighbor) and the arrested person. No Memo = Illegal Detention.
3. Offenses Under 7 Years
The Change: Under the new BNSS (replacing CrPC), for crimes with a maximum punishment of 7 years or less, police CANNOT arrest you directly.
Procedure: They must issue a "Notice of Appearance" first. Arresting without this notice is a violation of law.
4. Right to Inform Family
As soon as you are detained, you have a fundamental right to inform one friend or relative about your location. Police are obligated to facilitate this call.
5. Sunset to Sunrise Rule
No woman can be arrested after sunset and before sunrise, except in extraordinary circumstances with a Magistrate's prior permission. Also, only a female officer can search a woman.
6. Mandatory Medical Checkup
Every arrested person has the right to be examined by a medical officer. This creates a record of your physical condition, preventing "Third Degree" torture in custody.
7. The 24-Hour Production Rule
Police must produce an arrested person before the nearest Magistrate within 24 hours (excluding travel time). Keeping someone longer without a court order is a crime.
8. Prosecution of Police (BNS 198)
If a police officer knowingly disobeys the law to cause injury to you or frames you with false evidence, they can be imprisoned. You can sue the officer personally.
9. Where to File a Complaint?
- SP Office: Send a written complaint via registered post to the Superintendent of Police.
- PCA: The Police Complaints Authority handles cases of serious misconduct.
- Magistrate: File a Private Complaint under Section 223 BNSS.
